[CBC] Shai Gilgeous-Alexander wins lawsuit to undo purchase of mansion where Ontario Crypto King lived | Judgment expands what sellers need to disclose about a house, real estate lawyer says

https://www.cbc.ca/news/canada/toronto/basketball-star-shai-gilgeous-alexander-wins-lawsuit-undo-home-sale-1.7052140

>The suit alleged the sellers fraudulently misrepresented the luxury home by failing to disclose an alleged series of threatening visits to the property — happening daily, at times — by those looking for Pleterski [Crypto King] before the NBA star bought it.

[…]

>[The judge] voided Gilgeous-Alexander’s purchase of the home and awarded the basketball player damages for mortgage and insurance payments he’s had to pay since starting the lawsuit.

[…]

> “[The seller] suppressed the truth about the Burlington property, which in this case amounted to a fraudulent misrepresentation,” wrote Centa in his Nov. 27 decision.

[…]

>As previously reported, just days after moving into their new house, a stranger appeared at the door looking for Pleterski. Unnerved by the visit, Gilgeous-Alexander’s girlfriend reported the incident to police

[…]

>A contact in the private security business also told the couple “Mr. Pleterski had defrauded some ‘very bad people’ and that someone had threatened to burn down their new house,” according to the judgment. “Whether or not these latter statements were true, [the couple was] sufficiently alarmed by this news that they moved out of their newly purchased dream house, never to return,” wrote Centa. “As is now clear, the persons behind the vendor of the Burlington property knew all of this and much more when they listed it for sale. None of this information was disclosed when the Burlington property was marketed and sold.”

Edit : just put some stuff in square brackets to show I slightly edited 2 sentences for people to understand better

  1. Do we have to know everything about these players lives?

good for him!!! that purchase was seriously fucked , anyone who read into the details of what it was like living there could see how he was duped. people stopping by at random hours looking for the former owner who was involved in shady deals

reminds me of when i lived in brooklyn, i signed a lease in a really nice place.

but as it turned out, the apartment below used to throw huge orgies every saturday. im talking about like contraptions and gimp suits drying out in the backyard when they werent being used

i couldnt even get any sleep above…shady landlords and property owners will do anything to close the sale

It was clearly a material fact that should be disclosed.

The Pleterski dude was kidnapped and had his face beaten in. Google image has him with luxury cars and one with his face swollen.

Well, that was fuckin quick! In the US, everyone would have been driving space cars by the time this went to court.

But some reddit lawyer told me this wouldn’t happen. Where is he now

  7. You’d think after the first run in the dumbasses would realise the dude doesn’t live there anymore.

/u/Neemzeh looks like you were mostly right in that this judgement was an expansion of what needs to be disclosed. (if you remember our discussion from a month ago)

I think the expansion makes sense though in light of the facts. anyway I’m just a law student and you’re a managing partner so I am not at all surprised that you knew the law better haha

edit: may be reversed on appeal tho we shall see
